POLICY REGARDING USE OF CITY LOGO FOR COMMUNITY BRANDING

1.0 PURPOSE

To state the policy of The City of Ankeny regarding the use of its seal and logos.

4.0 POLICY

4.1 The City of Ankeny is the owner of all rights, titles and interests in and to certain designations comprising designs, trade names, trademarks and service marks including, without limitation, the names "City of Ankeny, Iowa," "City of Ankeny," "Ankeny, Iowa" and "Bringing It All Together" logotypes and seals incorporating one or more of the foregoing names and/or abbreviations, and certain logo graphics and/or symbols which have come to be associated with the City of Ankeny, Iowa. 

4.2 In consideration of the valuable property rights inherent in the City of Ankeny, Iowa, name and indicia which are inseparable from the good name and reputation of the City of Ankeny, Iowa, both domestically and internationally, this policy is established to govern the use of the City of Ankeny, Iowa, name and indicia. 

4.3 Use of the Official City Business Logo and the Alternate Official City Logo is controlled by the City Council and is delegated to the City Manager. No use of those logos shall be made except in connection with official City of Ankeny letterhead, brochures, publications, pamphlets, signs, patches, insignias, paintings, messaging devices, postings, and website. 

4.4 Use of the Official City Logo for Community Branding is controlled by the City Council and control of that use is delegated to the City Manager for application in accordance with this policy.4.5 Use of the Official City Logo for Community Branding on or in connection with items offered for sale shall only be permitted in accordance with this policy. 

4.6 Use of the Official City Logo for Community Branding on or in connection with items offered for sale by not-for-profit organizations may be permitted without payment of a fee for use of the Official City Logo for Community Branding by that not for profit organization under the following circumstances: 

4.6.1 The organization must be community based and a recognized not-for-profit organization either by the United States or the State of Iowa. 

4.6.2 Use of the logo will be restricted to events or merchandise sales by that not-for-profit organization and must be demonstrated, before use, to be community based in nature (i.e. Summerfest) and open to participation in or purchase by all citizens of Ankeny or visitors to the City of Ankeny. When the City Manager determines these conditions are met, the City Manager may issue permission for the use of the Official City Logo for Community Branding for the duration of the event or sales period. Prior to any use of the Official City Logo for Community Branding, the not-for-profit organization must execute, through an official acting with appropriate authority, an agreement permitting the limited use of the Official City Logo for Community Branding granted by the City Manager. 

4.7 Use of the Official City Logo for Community Branding on or in connection with events or items offered for sale by for-profit organizations may be permitted with payment of a license fee for use of the Official City Logo for Community Branding by that for-profit organization under the following circumstances: 

4.7.1 The organization must have a City of Ankeny address if the point of sale will be within the city limits. 

4.7.2 Use of the logo will be restricted to events or merchandise sales as established by the terms of the license agreement permitting use of the Official City Logo for Community Branding. 

4.8 The City of Ankeny will consider licensing most events and products using the Official City Logo for Community Branding so long as the City is represented in a positive manner. However, the City of Ankeny will not license unacceptable items including, but not limited to, the following products: alcohol, tobacco, gambling products, knives, guns, miscellaneous weaponry, cigarettes, cigarette lighters, shot glasses, phone debit cards, pornography, and apparel with sexually explicit or off color sayings. 

4.9 The cost for a standard license agreement is five percent (5%) of the gross sales amount of the first sale of all items bearing the logo unless otherwise waived. The fees shall be paid at least quarterly unless the license agreement for use provides a different payment schedule. Prior to any use of the Official City Logo for Community Branding, the for-profit organization must execute, through an officer or principal acting with appropriate authority, an agreement permitting the limited use of the Official City Logo for Community Branding granted by the City Manager.

5.0 DEFINITIONS

As provided by the City of Ankeny Municipal Code.

6.0 PROCEDURES

6.1 Any organization wishing to use the Official City Logo for Community Branding shall make application for such use to the City Manager's Office on the application form previously approved or amended by the City Council, a copy of which is attached for reference. 

6.2 All applications shall be forwarded promptly to the office of the City Manager for review. The City Manager shall review such applications and determine whether the applications should be approved, modified or denied. Any organization feeling aggrieved by the decision of the City Manager may make a written appeal of the City Manager's decision within fourteen (14) days of the City Manager's decision to the City Council. The appeal shall be placed on the next available City Council agenda. The City Council may affirm the City Manager's decision or direct the City Manager to provide a licensing agreement to the applicant. The decision of the City Council shall be final.
